We provide staffing, recruiting, project consulting, and workforce management services to businesses across multiple industries, including direct hire placement, high-volume frontline staffing, and project-based consulting engagements.

In the course of delivering these services, we collect and process personal information from job candidates, clients, and visitors to our website. This Privacy Policy describes how we collect, use, share, and protect that information.

Information We Collect About Candidates

In the course of providing staffing, recruiting, and workforce solutions, FlexTek collects and processes personal information about job candidates and applicants. This section describes the types of information we collect and the sources from which we obtain it.

  • Professional references and referral information
  • Compensation expectations and availability
  • Work authorization status
  • Any additional information you voluntarily provide during interviews or communications

Information from Third-Party Sources

We may also collect candidate information from:

  • Job boards and career platforms where you have posted your profile or applied to positions
  • Professional networking sites and publicly available professional profiles
  • Client referrals and employee referral programs
  • Background check and verification providers (with your consent)
  • Our applicant tracking system where your information may have been stored from prior applications or engagements

Information Generated During the Recruiting Process

Through our recruiting activities, we may generate additional information, including:

  • Interview notes, assessments, and evaluator feedback
  • Interview transcriptions and AI-generated summaries of interview conversations
  • Candidate summaries and write-ups prepared for client review
  • Skills assessments and screening results
  • Communication records related to your candidacy

Information We Collect from Clients

When we engage with businesses as clients or prospective clients, we may collect the following types of information:

Client Contact and Business Information

  • Names, titles, email addresses, and phone numbers of client contacts, hiring managers, and key personnel
  • Company name, address, and industry
  • Billing and payment information necessary to process invoices and service agreements
  • Job requirements, position descriptions, and hiring preferences
  • Contractual and engagement records

How We Use Client Information

We use client information to:

  • Deliver staffing, recruiting, and project consulting services
  • Communicate about open positions, candidate submissions, and engagement status
  • Process billing, invoicing, and payments
  • Maintain records of our business relationship and service history
  • Support administrative functions such as meeting notes, scheduling, and internal documentation using AI-assisted tools
  • Comply with legal and regulatory obligations

AI tools may be used in an administrative capacity to support client communications, such as transcribing and summarizing meetings or calls. These tools assist with documentation and record-keeping and are not used to make decisions about the client relationship.

How We Use Candidate Information

Recruiting and Placement Services

We use the personal information we collect for the following purposes:

  • Evaluating your qualifications for current and future job opportunities
  • Matching your skills and experience to client job requirements
  • Preparing and formatting your resume or candidate profile for client submission
  • Generating candidate summaries and write-ups to facilitate the hiring process
  • Communicating with you about job opportunities, interview scheduling, and application status
  • Conducting reference checks and background verification (with your consent)

AI-Assisted Processing

Some interviews conducted by phone or video may be recorded and transcribed using AI-assisted tools to support accurate documentation. When recording is used, candidates will be notified at the time of the interview.

FlexTek may use artificial intelligence (AI) and automated tools to assist with certain recruiting activities. These tools are designed to improve efficiency and consistency in our processes. Specifically, AI-assisted tools may be used to:

  • Parse and analyze resumes to identify relevant skills, experience, and qualifications
  • Match candidate profiles against job requirements to identify potential opportunities
  • Reformat resumes and candidate profiles into standardized templates for client presentation
  • Generate preliminary candidate summaries or write-ups based on resume data and interview notes
  • Transcribe and summarize interviews to support recruiter documentation and record-keeping
  • Search our existing candidate database to identify individuals who may be a fit for new opportunities

All AI-assisted outputs are reviewed by our recruiting professionals before any action is taken. AI tools are used to support — not replace — human decision-making in the recruiting process. No candidate is automatically disqualified or advanced solely on the basis of automated processing.

Business Operations

Maintaining and improving our recruiting services and internal processes

Complying with legal and regulatory obligations

Responding to legal claims, regulatory inquiries, or law enforcement requests

Analyzing aggregate, de-identified data to improve service quality

Automated Decision-Making and Profiling

FlexTek may use automated tools to assist in evaluating and matching candidate profiles to job opportunities. This may constitute “profiling” under applicable law, as it involves the automated processing of personal data to analyze or predict aspects of a candidate’s professional qualifications, skills, or suitability for a role.

We want you to understand the following about our automated processing:

What automated tools do: Our AI-assisted tools may analyze your resume, professional history, and other candidate data to identify potential matches with open positions or to generate summaries of your qualifications. These tools help our recruiters work more efficiently but do not make hiring decisions. Interview transcription and summarization tools capture and organize information from conversations but do not score, rank, or evaluate candidates.

What automated tools do not do: Automated tools are not used as the sole basis for any decision that significantly affects your candidacy. A qualified recruiter always reviews AI-assisted outputs before any candidate is submitted to a client, advanced in a process, or declined for a position.

Your right to opt out: Under the Texas Data Privacy and Security Act (TDPSA), you have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects, including employment decisions. To exercise this right, please contact us at sglenn@flextekllc.com or (832) 709-2995.

What happens if you opt out: If you opt out of automated profiling, we will ensure that your candidate data is excluded from AI-assisted matching and screening processes. Your information will still be available to our recruiters for manual review and consideration for opportunities. Opting out will not negatively affect your candidacy.

How We Share Candidate and Client Information

We may share personal information with the following categories of recipients:

Clients and Prospective Employers: When a candidate is being considered for a position, we may share their resume, candidate profile, and related information with the client or prospective employer. We will not submit candidate information to a client without the candidate’s knowledge.

Service Providers and Processors: We use third-party service providers to support our operations, including our applicant tracking system, cloud hosting providers, communication platforms, and AI-assisted tools. These providers process data on our behalf and are contractually bound to protect your information.

Background Check Providers: With explicit consent, we may share necessary information with background check and verification providers.

Legal and Regulatory: We may disclose information if required by law, regulation, or legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

We do not sell personal data to third parties.

Your Rights Under Texas Law

If you are a Texas resident, you have the following rights under the Texas Data Privacy and Security Act (TDPSA):

Right to Access: You may request confirmation of whether we are processing your personal data and request access to that data.

Right to Correction: You may request that we correct inaccuracies in your personal data.

Right to Deletion: You may request that we delete personal data you have provided to us or that we have obtained about you, subject to certain exceptions.

Right to Data Portability: You may request a copy of your personal data in a portable and readily usable format.

Right to Opt Out: You may opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (including employment decisions).

Right to Non-Discrimination: We will not discriminate against you for exercising any of your rights under the TDPSA.

To exercise any of these rights, please contact us using the information provided in the Contact Us section below. We will respond to your request within 45 days. If we need additional time, we will notify you of the extension and the reason for it. If we decline your request, we will provide the reasons and information on how to appeal. If we decline to take action on an eligible privacy request, you may appeal by replying to our decision or submitting an appeal via email with “Privacy Appeal” in the subject line. Please include the request reference information provided in our response. We will respond to the appeal in writing within the time required by applicable law. If we deny the appeal, we will provide information about how to submit a complaint to the appropriate regulatory authority.

You may access more information about your rights pursuant to the Texas Data Privacy and Security Act at the following link: https://www.texasattorneygeneral.gov/consumer-protection/file-consumer-complaint/consumer-privacy-rights/texas-data-privacy-and-security-act.

Depending on your state of residence and applicable law, you may have rights regarding your personal information, including the right to request access, correction, deletion or a copy of certain information. FlexTek may also provide these choices voluntarily where not required by law. Requests are subject to verification, legal requirements and applicable exceptions.
